Purpose and content of this Financial Services Guide

This Financial Services Guide (FSG) is provided to inform you about the financial services provided by Jamieson Private Wealth Pty Ltd (we, us, our) and to assist you in deciding whether to use our services.

This FSG contains important information about:

  • Other documents you may receive from us

  • Financial services we may provide;

  • Who will give you advice;

  • Fees and charges you may pay;

  • Other benefits we (and other relevant people) may receive;

  • Relationships that may influence the advice we provide;

  • Your privacy and personal information;

  • How we handle complaints and disputes;

  • Compensation arrangements we have in place; and

  • How to contact us.


Independence

Section 923A of the Corporations Act defines the term of independence in that a person in the course of providing financial advice does not receive commission payments.

Jamieson Private Wealth currently hold it’s own Australian Financial Services License but as part of it is insurance recommendations has the ability to receive the commission payments in lieu of charging the client a fee for the provision of this advice, it also has the ability to rebate this insurance commission.

Due to this conflict of interest we do not meet the ASIC terms of independence as described under this section of the Corporation Act.

Other documents you may receive from us

In addition to this FSG, you may receive other documents from us:

  • Statement of Advice (SOA) – This document is a written record of the personal advice we provide to you. It will set out our understanding of your relevant investment objectives, financial situation and needs, our recommendations and the basis for them. It will also contain disclosures about relevant fees, commissions and benefits, as well as associations that may influence our advice. We are generally obliged to provide a SOA the first time we provide you with personal advice about a financial product or where there has been a significant change in your relevant circumstances.

  • Record of Advice (ROA) – We generally prepare an ROA where we provide personal advice in circumstances where we are not obliged to provide a SOA (such as further advice where there has been no significant change in your relevant personal circumstances, advice about small investments, advice about certain deposit products or where we do not recommend the purchase or sale of a financial product). The ROA will set out the advice, information or statement given and provide brief particulars of the basis for the advice, or of the information or statement given. This is kept on file, you may request one by writing to us within 7 years after the advice was given. Our contact details are set out at the end of this FSG.

  • A Product Disclosure Statement (PDS) – This document is usually prepared by the issuer or seller of a financial product and contains information about the product, such as its features, benefits, fees and risks. We are generally obliged to give you a PDS in relation to any offer or recommendation to invest in a financial product. Exceptions include products such as securities, products you already own, basic deposit products and self-managed superannuation funds. A prospectus or other offer document not a PDS) may be issued for some financial products (such as listed shares).

Financial services we may provide

We are authorised to provide financial product advice about, and to deal in, the following kinds of financial products:

  • Deposit products

  • Debentures, stocks or bonds issued or proposed to be issued by a government

  • Life products

  • Interests in managed investment schemes including investor directed portfolio services

  • Retirement savings accounts

  • Securities

  • Standard margin lending facilities

  • Superannuation

We are also authorised to provide financial product advice for foreign exchange contracts.

Generally, we act for you in providing financial services to you. Sometimes, we may act as your agent to give instructions to a broker on your behalf to trade in local or international stock exchanges or

financial markets. We do not have control or discretion over orders once they are submitted to the broker.

Sometimes we may collect personal information about you for disclosure to third parties, in order to facilitate investments. We will handle your personal information in accordance with our Privacy Policy, which is referred to later in this FSG.

How you may instruct us

You may choose to give us instructions in person, by telephone, by email, by fax or by mail, using the contact details set out at the end of this FSG.

Who are our advisors and how are they paid?

Our advisors are representatives who we have approved. Your advisor is either a director of Jamieson Private Wealth Pty Ltd or a salaried employee.

Salaried employees may be eligible to receive performance-based payments based on a range of criteria. Our incentives reward commitment to our goals and service standards. They are not designed to influence the choice of products recommended or the financial product advice given.

Fees and charges you may pay us

Generally, we will meet with you to obtain information about your objectives, financial situation and needs. With your consent, we will use and disclose (as appropriate) your personal information to consider, make and provide you with our recommendations. You are not obliged to pay us a fee for those services.

If we are engaged to prepare a formal set of recommendations this will typically cost around $3,500-

$5,500 for this scoped work.

A fixed annual fee will be payable if you engage us to implement recommendations we have made. We generally act on your behalf when we provide financial advice or financial services to you.

If we are engaged for ongoing work, currently our fixed annual fees is $5,500 (including GST) or maybe tailored specific to your set of requirements. If you decide to implement the advice yourself there will be no further charges raised beyond the cost to prepare the formal recommendations.

If we are engaged ongoing, we will charge you the applicable fixed annual fee on an ongoing basis until our engagement terminates (for any reason including by operation of law). We will provide you with a fee disclosure statement where required by law, to inform you about the amount of each ongoing fee you have paid in the prior year. At present we are obliged to provide a fee disclosure statement annually within 30 days of the end of the year to which the fees relate.

If you decide to proceed with our recommendations and later decide to terminate our services within 12 months of the date of this Statement of Advice you will be charged the outstanding balance of the full annual fee.

Remuneration and benefits we receive from others

Insurance

If we facilitate an investment in a general insurance or life insurance product, we act for you in facilitating the investment (not for the provider of the product). Nevertheless, it is likely that we will be entitled to receive remuneration from the provider of the insurance product. That remuneration is not an additional cost to you.

Typically, our remuneration on these products will take the form of an up-front commission or an ongoing commission, or both. Standard up-front commission ranges from 0-66% of the initial annual premium and standard on-going commission ranges from 0-40% of each applicable annual premium. From time to time, providers may also offer additional benefits. Commission arrangements vary between different products and providers, so the exact remuneration to which we may become entitled is not ascertainable at this time.

We will disclose the remuneration to which we may be entitled if our recommendations are implemented, or the method for calculating that remuneration, at the time we provide our written recommendations to you or as soon as we practically can after that.

Referral fees

We will not receive fees if we refer you to any other person and we are not required to pay fees to any person who may have referred you to us.

Remuneration or benefits received by our associates

Except as set out in this FSG, no-one listed below is to receive any remuneration (including commission) or other benefits in respect of, or that is attributable to, the provision of financial services that we are authorised to provide:

  • Us

  • Any of our related bodies corporate;

  • Any director or employee of any of our related bodies corporate; and

  • Any associate of a person listed above.

Associations and relationships

Except as disclosed earlier in this FSG, no relationship or association exists between us or any related body corporate, and the issuer of any financial product, that might reasonably be expected to be capable of influencing the provision of any financial services that we are authorised to provide.

Privacy and personal information

We usually seek to collect personal information about you and your financial circumstances for purposes related to the financial services that we provide.

We will seek your consent to collecting, using and disclosing your personal information in accordance with our Privacy Policy.

Laws relating to handling of personal information may change from time to time, and we may change our Privacy Policy. Please check our website (www.jamiesonprivatewealth.com.au) from time to time to view the most current version of our Privacy Policy.

Complaints and dispute resolution

Our dispute resolution system comprises an internal dispute resolution procedure and membership of an external dispute resolution scheme. We value customer relationships and endeavour to resolve complaints genuinely, promptly, fairly and consistently.

Internal dispute resolution procedure

If you wish to express dissatisfaction with our products or services, please mail your complaint to our “Complaints Manager”, using the contact details set out at the end of this FSG. Please use the heading “Complaint” on your document, explain why you are not satisfied and inform us of the resolution you are seeking.

If the complaint is not resolved to your satisfaction within 5 business days after we receive it, our full internal dispute resolution process will apply. In that case, your complaint will be investigated and we will inform you of the final outcome in writing within 45 days after we receive the complaint (or within 90 days for certain complaints about superannuation) or provided with the reasons for the delay if we are not able to respond within that time. We will also notify you of your right to take the complaint to an external dispute resolution scheme and as to the name and contact details of that scheme.

External dispute resolution scheme

We are a member of the Australian Financial Complaints Authority (AFCA), which is an external dispute resolution scheme approved by the Australian Securities and Investments Commission. AFCA offers independent dispute resolution and is free to consumers. There are limits on claims and compensation, which are described on the AFCA website. Compensation arrangements we have in place

To ensure that adequate resources are available to meet claims against us, we have arranged to hold a policy of professional indemnity insurance. The policy covers (subject to its terms and conditions) claims arising from the financial services that we and our representatives are authorised to provide under our AFSL. These arrangements satisfy the requirements for compensation arrangements under section 912B of the Corporations Act 2001.

Please note that you are not entitled to make a direct claim on our policy of insurance.
